General

1. These terms and conditions apply to users who are consumers for purposes of the Consumer Protection Act, 68 of 2008 (the “CPA”).
   
2. No content in these terms and conditions is intended to unlawfully restrict, limit or avoid any rights or obligations for either Solar Lane or you, the consumer.
3. You may not cede, assign or otherwise transfer your rights and obligations in terms of these terms and conditions to any third party.
4. Any failure on the part of you or Solar Lane to enforce any right in terms hereof shall not constitute a waiver of that right.
5. If any term or condition contained herein is declared invalid, the remaining terms and conditions will remain in full force and effect.
6. No variation, addition, deletion, or agreed cancellation of the terms and conditions will be of any force or effect unless in writing and accepted by or on behalf of the parties hereto.
7. These website terms and conditions (“terms and conditions”) govern the ordering, sale and delivery of goods and the use of the website.
8. These terms and conditions are binding and enforceable against every person that accesses or uses this website (“you”, “your” or “user”), including without limitation each user who registers as contemplated below (“registered user”). By using and registering on the website you acknowledge that you have read and agree to be bound by these terms and conditions. It is your responsibility to contact Solar Lane should you require any clarification on any of the listed provisions within these terms and conditions. Do not use the website if you do not agree to the terms and conditions.
9. The website https://solarlane.co.za/and any related mobile-sites and software applications (the “website”) and is owned and operated by Solar Lane.
10. Solar Lane may, in its sole discretion, at any time and for any reason and without prior written notice, suspend or terminate the operation of the website or the user’s right to use the website or any of its contents subject to us processing any orders then already made by you.
11. You must register to order from the website. You agree that, once the correct username and password relating to your account have been entered, irrespective of whether the use of the username and password is unauthorized or fraudulent, you will be liable for payment of such order, save where the order is canceled by you in accordance with these terms and conditions. You agree to notify Solar Lane immediately upon becoming aware of or reasonably suspecting any unauthorized access to or use of your username and password and to take steps to mitigate any resultant loss or harm.
12. By using the website, you warrant that you are 18 (eighteen) years of age or older and of full legal capacity. If you are under the age of 18 (eighteen) or if you are not legally permitted to enter into a binding agreement, then you may use the website only with the involvement and supervision of your parent or legal guardian. If your parent or legal guardian supervises you and gives his/her consent, then such person agrees to be bound to these terms and conditions and to be liable and responsible for you and all your obligations under these terms and conditions.
13. You agree not to use the website to distribute material that is defamatory, offensive, contains or amounts to hate speech or is otherwise unlawful.
14. You may not in any way display, publish, copy, print, post or otherwise use the website and/or the information contained therein without the express prior written consent of an authorized Solar Lane representative.
15. We respect your privacy and will take reasonable measures to protect it. We are entitled to use or disclose your personal information if such use or disclosure is required to comply with any applicable law, subpoena, order of court or legal process served on us, or to protect and defend our rights or property. In the event of a fraudulent online payment, Solar Lane is entitled to disclose relevant personal information for criminal investigation purposes or in line with any other legal obligation for disclosure of the personal information which may be required of it. We will ensure that all of our employees, third-party service providers, divisions and partners having access to your personal information are bound by appropriate and legally binding confidentiality obligations in relation to your personal information. Should you so require we will delete your personal information from our database, on written notice by you, and upon completion of all obligations between Solar Lane and yourself. This will in no way create an obligation for Solar Lane to ensure that your personal information is deleted from third-party databases. Should there be any legal proceedings between Solar Lane and yourself, Solar Lane will delete your personal information, as per your notice, upon finalization of all legal disputes.
16. All notices in terms of these terms and conditions must be sent either by hand, prepaid registered post, telefax or email and must be in English. All notices sent –
1. By hand will be deemed to have been received on the date of delivery;
2. By prepaid registered post, will be deemed to have been received 10 days after the date of posting;
3. By email will be deemed to have been on the date indicated in the “read receipt” notification. All email communications between you and us must make use of the “read receipt” function to serve as proof that an email has been

These terms and conditions and our relationship and/or any dispute arising from or in connection with these terms and conditions shall be governed and interpreted in accordance with the laws of the Republic of South Africa. Your continued use of the website will constitute your consent and submission to the jurisdiction of the South African courts regarding all proceedings, transactions, applications or the like instituted
18. Nothing in these terms and conditions limits your right to approach any court, tribunal or forum of competent jurisdiction in terms of the CPA.

Sales & Availability of Stock

1. Registered users may place orders for goods, which Solar Lane may accept or reject. Whether or not Solar Lane accepts an order depends on the availability of goods, correctness of the information relating to the goods (including without limitation the price) and receipt of payment or payment authorization by Solar Lane for the goods.
2. Note: Solar Lane will indicate the acceptance of your order by organizing the delivery of the goods to you or allowing you to collect them (please see here for more information). Only at that point will an agreement of sale between you and Solar Lane come into effect (the “sale”). This is regardless of any communication from Solar Lane stating that your order or payment has been confirmed. Solar Lane will indicate the rejection of your order by canceling it and, as soon as possible thereafter, refunding you for any amount already paid.
3. Prior to delivery or your collection of the goods, you may cancel an order at any time provided you do so before receiving a dispatch or delivery notice. After delivery or your collection of the goods, you may return the goods only in accordance with the returns policy. All canceled orders are liable to incur a 20% handling fee.
4. Placing goods in a wish list or shopping basket without completing the purchase cycle does not constitute an order for such goods, and as such, goods may be removed from the shopping basket if stock is no longer available or the price thereof might change without notice to you. You cannot hold Solar Lane liable if such goods are not available or are not available at the price when you complete or attempt to complete the purchase cycle at a later stage.
5. You acknowledge that stock of all goods on offer is limited and that pricing may change at any time without notice to you. In the case of goods for sale by Solar Lane, Solar Lane will take all reasonable efforts to monitor stock levels and ensure that when stock is no longer available, that offers thereof are discontinued on the website. However, we cannot guarantee the availability of stock. When goods are no longer available after you have placed an order, Solar Lane will notify you and you will be entitled to a refund of any amount already paid by you for such goods.
6. We shall take all reasonable efforts to accurately reflect the description, availability, purchase price and delivery charges of goods on the website. However, should there be any errors of whatsoever nature on the website (which are not due to our gross negligence), we shall not be liable for any loss, claim or expense relating to a transaction based on any error, save – in the case of any incorrect purchase price – to the extent of refunding you for any amount already paid. 

Payment

1. We are committed to providing secure online payment facilities. All transactions are encrypted using appropriate encryption technology.
2. Whether the goods are for sale by Solar Lane payment can be made for goods via:
1. Electronic Funds Transfer (EFT)
2. Debit/credit card payments.
3. Direct bank transfer
3. Note: not all payment methods are available for all products.
4. Once you have selected your payment method, you will be directed to a link to a secure site for payment of the applicable purchase price for the goods.
5. All payments must appear in our bank account before goods are released, unless otherwise specifically stated in our quotation.
6. Prices quoted are subject to exchange rate fluctuations and any variation will be for the customer’s account should the invoice value change between quotation and order placement.
7. Quotations are valid for 2 calendar days from the date of the quotation for existing stock only. Quoting of existing stock does not in any way reserve the stock on your behalf and in no way guarantees that the stock will be available when you want to complete the sale at a later stage. Should stock become unavailable during the 2 calendar day period, the quotation will lapse.
8. All quotations are subject to our payment terms.

Pricing

Price, specifications and terms are subject to change, you are therefore requested to peruse the prices, specifications and terms prior to placing any order. The purchase price will be the current price as appearing on Solarlane.co.za’s website www.solarlane.co.za.

If prior to delivery of the goods, there is any increase in the cost of the goods, or if any other taxes or duties are levied or any laws are promulgated which directly or indirectly increase the cost thereof to the company, the company shall be entitled to increase the price of the goods by an amount equal to such increased cost, by giving you reasonable notice thereof.

Change of Orders 

All orders and variations to orders are subject to these terms and conditions. Only written orders and variations to orders will be accepted by Solarlane.co.za. Notwithstanding the above, solarlane.co.za may, at its sole discretion, elect to accept and act upon telephonic orders and any variations to orders. solarlane.co.za, however, reserves the right to refuse delivery or collection of any order until placed in possession of a written order form.

Cancellation of Orders

Requests for cancellation of an order, prior to delivery, must be submitted in writing to george@solarlane.co.za.

No refunds will, however, be furnished on deposits in the event of cancellation for specially ordered or manufactured goods.

Any order is subject to cancellation by Solarlane.co.za should the goods ordered become unavailable due to any cause beyond Solarlane.co.za’s reasonable control.

Processing Times policy

You can expect an order to be processed within approximately three to five business days, provided the items are in stock and the payment has been verified. solarlane.co.za, therefore, cannot guarantee same-day shipping. Customers should also note that no orders will be processed on weekends and official public holidays.

Back Orders

solarlane.co.za will notify you should there be any delay in obtaining/delivering any goods ordered. The unavailable order will be placed on backorder, and the remainder of the order placed will be shipped. Please check our website for the back ordered items estimated time of arrival. Please note that the dates reflected are estimates and Solarlane.co.za cannot guarantee the arrival dates. Should the backorder, however, remain undelivered 30 (thirty) days from the date the order was placed you may cancel the agreement by giving solarlane.co.za 7 (seven) days written notice. Any order is subject to cancellation by Solarlane.co.za should the goods ordered become unavailable due to circumstances beyond Solarlane.co.za’s reasonable control.

Delivery of Goods

1. Solar Lane offers 1 (one) method of delivery of goods to you. By a third-party Courier.
2. The delivery charges are subject to change at any time, without prior notice to you. You will see the applicable delivery charges in your cart when you check out.
3. Where it accepts your order, Solar Lane will deliver the goods to you as soon as reasonably possible, we will notify you if we are unable to deliver the goods during the delivery period. Should any delays that are beyond Solar Lane’s control take place, Solar Lane will not be liable for any costs or losses incurred by the customer through such a delay.
4. Solar Lane’s obligation to deliver a product to you is fulfilled when the courier collects the product from our premises. Solar Lane is not responsible for any loss or unauthorized use of a product after the order has been collected.
5. The suitability of the goods for the use contemplated by the client is the sole responsibility of the client, and the company shall in no way be responsible for the suitability of the goods sold for any end use.
6. Solar Lane is not responsible for goods lost or damaged in transit.

Warranty Claims

To the extent allowed by law, and notwithstanding any other provision of this agreement: 

• Any goods supplied by the company shall be subject to the manufacturing or distributing company’s warranty.
• The sole entitlement you shall have in respect of those goods shall be to require Solarlane.co.za to enforce such warranty against the manufacturer or distributor of those goods on your behalf.
• All goods and items are to be returned to Solar Lane at the given address at the customer's expense.
• Solar Lane does not carry any direct warranties on products we stock.

The warranty shall immediately be rendered null and void in the event of any of the following:

• Failure to use the products in accordance with instructions and specifications provided by the Manufacturer or Distributor.
• Should the product have been subjected to physical damage, abuse, misuse, alteration, neglect, tampering, or improper maintenance, or has been serviced, repaired, or installed by persons not possessing the necessary qualifications required to do so;
• The product is not returned with an invoice/verifiable method confirming proof of purchase.

What the warranties DO NOT cover

1.  You will not get a temporary replacement unit while your claim is being assessed
2. You will not get on-site assistance to remove the faulty item

No warranty claims will be entered into if the above is not adhered to and documentation may be required.

All goods and items are to be returned to our warehouse 13 Milan St, Airport Industria, Cape Town, 7490 at the customer's expense.
We do not offer any off-site warranty services.

Product terms & conditions

Due to the technical and complex nature of the products found on solarlane.co.za, the following warranty terms apply to all standby and solar systems which incorporate our products:

1. Solar Lane does not guarantee that the functioning or performance of a system is fit for purpose or meets the needs of the user.
2. Since Solar Lane does not install and/or implement any of the systems sold, Solar Lane is not liable for the suitability or production of the items sold.

Changes to these terms & conditions

1. Solar Lane may, in its sole discretion, change any of these terms and conditions at any time. It is your responsibility to regularly check these terms and conditions and make sure that you are satisfied with the changes. Should you not be satisfied, you must not place any further orders on, or in any other way use the website.
2. Any such change will only apply to your use of this website after the change is displayed on the website. If you use the website after such amended terms and conditions have been displayed on the website, you will be deemed to have accepted such changes
